Two Nancys, Two Elijahs: Vinedressing the Smallwood Genealogy No. 2

According to a Wikitree profile for William Smallwood Jr., he had a daughter Nancy.[1] The information at Wikitree matches other sites online, and the origin of this information is unknown to me but has been shared by many Smallwood researchers.

The information on Nancy reads:

Here are some records for the above marriages: 

Andrew Smith to Nancy Smallwood, marriage bond, 8 June 1807 in Clay County, Kentucky. [2]

John Smallwood was the bondsman.  Bondsmen are often fathers or brothers, but could be uncles or any other relative.  They are rarely random.

A marriage license was issued for the marriage.[3]  On the back of the license was written:

“I hereby certify that I joined together in the holley Estate of Mattromuny the within named persons on the 13th day of June 1807.  Ezekiel Smith”

Clayton Hern to Nancy Smallwood marriage bond was dated 29 March 1809 in Madison County, Kentucky.  It names two bondsmen—James Hern and Elijah Smallwood—but only Clayton and James signed the bond.[4]  Elijah was the witness to the marriage consent which states that Nancy is the daughter of William Smallwood.[5]

The reverse of the consent says, “Sworn to by Elijah Smallwood,” and is signed by the DC (Deputy Clerk).[6]

A red flag: If Nancy married Andrew Smith in 1807, why wasn’t she called Nancy Smith when she married Clayton Herndon—which is actually just Hern, not Herndon—in 1809?  Well, the answer is unequivocally, they are not the same Nancy!

Fortunately, both husbands served in the War of 1812, and both women applied for widow’s pensions.[7]

Nancy Smith began her requests for aid in 1871.  Initially, the application was rejected, but she tried again in 1878 and was more successful.  Nancy Hern submitted her application in 1871, but it was also rejected 9 March 1872. Fortunately for us, there is a lot of good information supplied by the unfortunate widows.

This timeline will compare the lives of both Nancys and confirm that they are separate women.  (I have put links to some documents in the footnotes.  I have not linked census records since they are easy to locate online.)

These records prove that there are two women named Nancy.  The marriages of the two Nancys also confirm that there were two separate Smallwood families living in Clay County and Madison County, Kentucky.  A website dedicated to Branson-Cook genealogy shares a lot on the Smallwoods.  That site attempted to connect Nancy (Smallwood) White to a woman in 1850 Clay County, but the pension information confirms she was not in Kentucky.[18]  There was also an Andrew Smith in Madison County, Kentucky–sometimes listed near the Smallwoods on tax lists–but he married Sarah Scrivner in 1807 and is not the spouse of Nancy Smallwood. A lot of online genealogy combines the two Smallwood families into one, creating a lot of confusion.  It is understandable because the names Nancy and Elijah appear in both groups.  Apparently, few Smallwood researchers realized that Elijah Smallwood in Clay County, Kentucky, was not the same person as Elijah C. Smallwood in Madison County, Kentucky.

There are at least two older Elijahs in Surry County, North Carolina—they are likely connected to the Clay Kentucky family.  There are several younger Elijahs—one (son of Samuel and Sarah (Akers) Smallwood) near Terre Haute, Indiana, and Coles County, Illinois, is a nephew to the Madison County Elijah.  There are Elisha Smallwoods as well. 

In an 1808 deed, Elijah Smallwood of 1807 Clay County is called “nephew” by John Smallwood also of Clay County.[40]  This John married Fanny Smith  on 25 Jan 1808 (bond)[41] with consent by her father, William.[42]  John and Fanny are found in Lawrence County, Tennessee, where John died in 1821.[43]  This is not the same as the John Smallwood listed in Shelby County, Kentucky, near William and Samuel Smallwood previously of Madison County.  John in Clay probably came from North Carolina and it is possible that he is the same man listed in 1790 and 1800 Surry County. Later there is a Jonathan in 1810 Surry who is not the earlier John. This Jonathan is listed next to the Howard family on the 1810 census.  This Jonathan or “John” married Judah (often listed as “India”) Howard. John and Judah moved to Georgia, and she is found on the 1850 census of Forsyth County.  There is also a John Smallwood listed in Fayette or Bourbon County on an early 1789 Kentucky petition.[44] This 1789 John is in Kentucky much earlier than the other Smallwood families.

This timeline will compare the lives of these Johns. These men have not been completely lined out.

The first John

The Nancy who married Andrew Smith, had bondsman, John Smallwood.  John could be her father, but since he was the uncle of Elijah Smallwood, maybe John is also uncle to Nancy.  Maybe Nancy and Elijah are siblings?  Elijah stayed in Clay County for more years than other Smallwoods, but in 1816 and 1817, he is joined by William Smallwood Sr., William Smallwood, Jr., and James Smallwood.  Previous researchers assumed James was a brother to Elijah, and if true, William Jr is probably another brother.  This could make William Smallwood Sr the father of all of the men and a brother to John Smallwood of Lawrence County, Tennessee.  It is also possible that William Sr is a brother to Elijah.  A William Sr and Jr, Elisha, and James located in Franklin County, Georgia in 1810 and 1816 could be these men.  Nancy’s father’s name is uncertain.

The second John

The “Bransoncook” website has a lot of Smallwood information.  On a page about the Shelby County, Kentucky, family, it says:

                “In 1820 Shelby, KY we find Samuel Smallwood and John Smallwood.  Samuel is identified,                  however John is not.  John was born between 1774 and 1794.  One would think this John was                  the brother of Samuel, however, that John was in Lawrence, TN in 1820. ”[46] 

The Samuel here is from Madison County, and later Shelby County, Kentucky; he is a son of William of Madison, Kentucky. Obviously, from the records, John in Clay County—and later Lawrence County, Tennessee–was not the brother of Samuel of Madison and Shelby County, Kentucky.  This makes it quite logical that John in Shelby County, Kentucky IS the brother of Samuel, thus the son of William of Madison County. 

The third John

It is possible this John is the husband to Cloa Smallwood listed on 1820 census of Jefferson County, Kentucky. A John Smallwood married Clowe Wilson in 1786 in Prince George’s County, but they appear to be listed in 1790 PG census.  More research on this John is needed.

The fourth John

This John appears in Surry County from at least 1790 to 1800.  He could be the same John who moved to Clay County, Kentucky, and died in 1821 in Lawrence County, Tennessee.  This is what seems most plausible.  If so, his “wife” shown in the early censuses must have died before 1808 when John of Clay sold all of his property to nephew Elijah.  No wife was named in that indenture, and John married Fanny Smith the next year. 

The fifth John

The fifth John married Judah Howard sometime before 1807 in Surry County, North Carolina.  This is confirmed by Deed N p59, where John Smallwood and his wife, Judah, and Elizabeth Howard, sell to their brother James Howard, land in Surry in 1807.   A John Smallwood is not found in the 1810 Surry census, but a Jonathan Smallwood is present.  He lives next door or with Elizabeth Howard and Charles Howard.

This strongly suggests that the older John Smallwood was gone from the county (thus could be John in Clay KY and Lawrence TN) and this younger Jonathan “John” was the man who married Judah Howard. John and Judah moved to Georgia.  He is very likely the John Smallwood on 1820 Habersham County Georgia census.  Hall County was adjacent to Habersham County, and Judah or Judith Smallwood is counted on the 1830 Hall County, Georgia census.  She is later in 1840 and 1850 in Forsyth County, Georgia. Continued research in the records of Georgia and Tennessee is needed to fully delineate all the Johns.

Two Russells and a Randolph

While I am at it, here are two contemporaneous Russell Smallwoods that need to be carefully separated.  Randolph, a brother to the first Russell is included in the chart.

The Bureau of Land Management patents place Russell of Missouri in Madison County, Kentucky during the War of 1812.  Other records exist for this man in that county, where the older William Smallwood was also listed. Russell left Kentucky, marrying Margaret “Peggy” Briscoe.   The other Russell appears in 1824 in Grainger County, Tennessee.  His parentage is not confirmed, but possibly a part of the Surry County family.   A younger Russell Smallwood married Sally Maupin in 1840 in Madison County, Kentucky.  This must be the son of Elijah C. Smallwood, and he is listed on the 1837 Estill County tax list next to Elijah.  Younger Russell died about April 1859 in Boone County, Missouri.[69]  Another younger Russell married Jane Clark in 1832 in Floyd County, Indiana.  This is probably the son of Samuel and Sarah Smallwood since Floyd County was the family home of Sarah (Akers) Smallwood.  A third younger Russell is the son of John Smallwood of Shelby County, Kentucky, and his second wife, Jenny “Jane” Russell.  This last Russell married first Matilda Russell in 1842 in Shelby County, Kentucky, then second Catharine Sourbeer in 1845 same place.

The ultimate goal of vinedressing the Smallwood family is to create an accurate list of the children of William Smallwood of Madison and Shelby County, Kentucky, and locate his whereabouts before 1803.  This article seems to clearly place Nancy (Smallwood) Hern, Elijah C. Smallwood, one John Smallwood, a Russell Smallwood, as well as, one Randolph “Randall” Smallwood in the right locations to be related to William, and their ages place them as probable children.  This leaves a Nancy (Smallwood) White, a different Elijah, and another John to be a separate family group.

Separating men and women with the same first and last names is challenging.  These two Nancys plus the two Elijahs help to divine the different John Smallwoods.  This in turn helps to separate the many Williams who appear in colonial and early U.S. records.  Although there are many men named William Smallwood before 1800, it is a finite number!  When a William in one place disappears from the records in one locale, he may appear in records elsewhere.  By analyzing all the Williams in a specific range of years, one can get a pretty good idea of how many Williams existed.  The next article will create timelines for ALL–hopefully all–of the William Smallwoods who made records between 1600-1800 in the United States.  Stay Tuned!
